TITLE:                            Right-of-Way Technician

                                                                                                                  

LOCATION:                    Natural Resource Department

Division of Engineering & Water Resources

 

SALARY:                        $25.71 to $29.55 per hour

                                     

CLOSING DATE:             Thursday, April 6th, 2023 @ 5:30 p.m.

 

SPECIAL CONDITIONS:

This is a not Testing Designated Position (TDP) within the definition of the CSKT Drug Testing policy. The successful applicant, if not already employed by the Tribes must pass a pre-hire drug test and serve a mandatory six (6) month probationary period.

 

The Right-of-Way Technician is a highly skilled technical position with responsibilities in land records research, appraisal record keeping, property location, securing and granting of rights-of-way, and second level review of title plant examinations on land status.  The Technicians major duties and responsibilities include, but are not limited to the following:

 

  • Coordinate rights-of-way activities on behalf of DEWR Programs with other Tribal Departments as well as local, state and federal agencies required to determine rights-of-way easement requirements;
  • Insures multidisciplinary review of applications, required environmental processes, and, reclamation plan development;
  • Negotiates rights-of-way with utility companies, state highway department, railroads and others;
  • Completes rights-of-way documents by acquiring required appraisals, signatures, document recordation, preparing schedules for transfer of proceeds, and updating of land records and plat;
  • Insures that all required forms and paperwork affiliated with rights-of-way are completed in accordance with federal regulations;
  • Maintain Appraisal Request providing tracking number and elates when sent to Area OST/OAS offices for approval;
  • Maintain official quarterly and annual reports for Department Head and Tribal Chairman's signatures when communicating with the Office of Appraisal Services (OAS) in Portland;
  • Review completed appraisal from technical appraisers for general appraisers' review;
  • Coordinate with Natural Resources and Tribal Lands staff, BIA staff, Flathead Indian Irrigation Project staff, as owner representatives. Survey Services and other land related governments to compile information required for appraisal report;
  • Performs field investigations necessary to review applications, construction, reclamation and as otherwise required;
  • Maintain an up to date land access and rights-of-way records documentation and retrieval system;
  • Compiles necessary information for condemnation actions for federal government, as required;
  • Requests document recording and lands record update following transaction completion;
  • Responsible for determining which Federal regulations grants rights-of-way for each purpose across trust lands;
  • Performs other duties as required or assigned.

 

MINIMUM QUALIFICATIONS (AS REFLECTED ON THE TRIBAL EMPLOYMENT     APPLICATION)

  • The Technician is required to have a high school diploma or equivalent, with training or education in surveying, realty or some other land and/or natural resource-based related field. The position requires at least four (4) years of increasing responsible work experience in some land-related field; the experience should have included land location, land records research and map/aerial photograph interpretation.
  • Thorough knowledge of land description and location techniques, land record filing systems used in the realty field, legal documents used in grants of rights-of-way and easements, legal documents used in land transfers, and federal land regulations.
  • Basic knowledge of Indian Law.
  • Knowledge of engineering to interpret rights-of-way plats and determining centerline of road and metes and bounds.
  • High degree of skill in using maps, plats, aerial photos; high degree of skill in oral communication (especially listening); good skill in written communication.
  • Attain a Federal Clearance within six months of hire.
  • The employee must possess a Montana State Driver’s License and be insurable under the Tribal policy.
  • Employee must complete a defensive driving course within six months of hire and every three years thereafter, or after a traffic violation resulting in over $500 in damage.

DESIRABLE QUALIFICATIONS (AS DETERMINED BY THE INTERVIEW):

  • Ability for Data Entry into BIA or CSKT software programs (ie, TAAMS).
  • Ability to create data and tracking of Leases and Temporary Use Documents.
  • Ability to read, understand and apply formal documents such as contracts, deeds, rights-of-way.
  • Ability to establish and maintain effective working relationships with other employees, other agencies, and the general public.
  • Ability to work outdoors and alone as required.

  2. Certified copies of relevant academic transcripts and training certificates.
  3. Copy of valid Montana State Driver’s License and proof of insurance.
  4. Proof of enrollment from a federally recognized Tribe if other than CSKT.
  5. If you are claiming Veterans Preference, a copy of the DD214 must be submitted with the application.
